1. About these terms
These terms govern paid use of Can I Shoot This? ("CIST"), an online production-planning service for filmmakers. By purchasing or using CIST you enter a contract with BH Film Festival C.I.C.. Your statutory consumer rights are not excluded or restricted by these terms.
You must be at least 18 years old and legally capable of entering a contract to purchase CIST. A filmmaker under 18 should use CIST through a parent, guardian or other adult who is able to contract on their behalf.
2. What CIST provides
Tier 1 accepts a screenplay PDF of up to 30 screenplay pages, plus one optional title page. CIST uses automated analysis, user confirmation and deterministic production-planning software to create a production overview, screenplay breakdown, top-level shooting schedule, budget framework, feasibility assessment and downloadable production pack.
CIST is a planning tool. It does not replace a producer, production manager, first assistant director, lawyer, accountant, tax adviser, safety adviser, safeguarding professional, qualified child-performance adviser, insurer or any other professional whose advice may be required for a real production.
3. AI interpretation and human confirmation
Automated systems may misunderstand screenplay content, omit details or make incorrect inferences. CIST is designed around the principle that AI interprets, the filmmaker confirms and software calculates. You are responsible for reviewing and correcting the breakdown and for verifying all production-critical information before relying on it.
CIST does not assess or certify BFI cultural-test eligibility, tax-credit eligibility, legal compliance, child-performance licensing, funding eligibility, union compliance, insurance cover or health and safety compliance. Where these subjects are mentioned, CIST provides planning prompts or signposting only.
4. Your screenplay and intellectual property
You retain ownership of your screenplay and other material you upload. You confirm that you own the material or have sufficient authority to upload it and have it processed for the purposes of the service.
As between you and CIST, you may use, edit, export and share the project-specific production documents generated for your project. BH Film Festival C.I.C. retains all rights in the CIST software, workflow, generic templates, branding, database structures and underlying service design.
You must not use CIST to upload malicious files, interfere with the service, attempt to access another customer's project, reverse engineer protected service components, or use the service in a way that is unlawful or infringes another person's rights.
5. Single Project
A Single Project purchase creates one project credit. Creating an empty project does not consume that credit. The credit is consumed when the first screenplay analysis for that project begins. A retry of the same screenplay analysis does not consume another credit.
Once licensed to a project, that project remains accessible to the account even if the customer later uses a different access model, subject to account security, legal requirements and these terms.
6. Membership
Membership is billed monthly through Stripe. Each successful monthly payment adds one Tier 1 project credit to the customer account. Unused Membership-earned project credits roll over and remain available until used, including after Membership later ends. Membership has an initial minimum commitment of 3 successful monthly payments. Subject always to statutory cancellation rights, a normal contractual cancellation request made during that initial commitment is recorded immediately, billing continues through the minimum commitment, and the membership is then scheduled to end at the end of the applicable paid billing period.
After the minimum commitment is complete, normal cancellation takes effect at the end of the current paid billing period. If a payment fails, Membership may move to an on-hold state and no new monthly Membership credit is added until payment is restored. Existing projects and project credits already earned remain accessible.
Separately purchased unused Single Project credits are not consumed merely because Membership becomes active and survive a later end of Membership. When both an earned Membership credit and a PAYG Single Project credit are available, CIST uses the Membership-earned credit first.
7. Cooling-off and immediate performance
Consumers buying online will generally have a statutory 14-day cancellation period, subject to the rules that apply to services and digital content. CIST is designed to start immediately rather than wait 14 days. Before purchase you are therefore asked to expressly request immediate performance and to acknowledge the consequences explained in the Refund & Cancellation Policy.
The Membership minimum commitment does not override any statutory right to cancel. If a statutory cooling-off right applies, it takes priority over the ordinary contractual membership-cancellation process.
8. Prices and payment
The price shown immediately before checkout is the price for the selected plan. Stripe processes card payments. CIST does not receive or store your full card details. Any taxes or charges included in the displayed price will be shown through the checkout process as applicable.
9. Availability and analysis queue
Screenplay analysis may be queued. CIST does not guarantee that analysis begins immediately. The service may pause processing during API, hosting, security or configuration incidents in order to protect uploaded screenplays and avoid repeated failed processing. We will take reasonable steps to restore service, but uninterrupted availability is not guaranteed.
10. Production decisions and risk
Budgets, schedules, rates, locations, crew assumptions, child-performance rules, funding links and other planning material can change and may depend on facts CIST does not know. You remain responsible for the actual production, contractual commitments, expenditure, permits, licences, employment arrangements, safeguarding, insurance, safety and legal compliance.
A production-planning result such as "yes", "yes with conditions", an amber flag or a budget estimate is not a warranty that a film can safely, lawfully or successfully be produced for the stated cost or schedule.
11. Service faults and consumer rights
Nothing in these terms removes rights you may have where a paid service or digital product is not supplied with reasonable care and skill, is not as described, or otherwise fails to meet legal requirements. Please contact us promptly if you believe the service has failed.
12. Liability
Nothing in these terms excludes or limits liability where the law does not permit that. Subject to that, CIST is provided as a production-planning aid and is not responsible for losses caused by a customer treating unverified planning output as professional, legal, tax, safety, safeguarding or production-management advice.
13. Account security
You are responsible for keeping your login credentials secure and for notifying us if you believe your account has been compromised. We may temporarily restrict an account or service function where reasonably necessary to protect customers, projects, the website or payment systems.
14. Ending access
You may stop using CIST at any time. Ending Membership does not remove existing project licences. We may suspend or terminate access for serious misuse, unlawful activity, security threats or material breach of these terms. Where possible and appropriate, we will explain the reason.
15. Changes to these terms
We may update these terms for future purchases or renewals. The version accepted for a purchase is recorded by CIST. Material changes will not retrospectively remove statutory rights or rewrite a completed purchase without a lawful basis.
16. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, this does not deprive you of mandatory consumer protections or court rights that apply in your place of residence.
